1. Acceptance of Terms

By accessing and using Vector Witch ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

Vector Witch provides an AI-powered vector generation service that allows users to create vector graphics from text prompts and images. The Service includes:

AI-based SVG generation from text descriptions
Style transformation of uploaded images
Access to a public gallery of generated vectors
Download capabilities for generated content
API access for programmatic generation (with appropriate subscription)

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security and confidentiality of your account credentials
Accept responsibility for all activities that occur under your account
Immediately notify us of any unauthorized use of your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription Plans and Payment

Vector Witch offers various subscription tiers with different generation limits and features:

Free Plan: 5 generations per day
Starter: $10/month for 100 generations
Basic: $20/month for 300 generations
Pro: $40/month for 800 generations
Business: $80/month for 2,000 generations
Enterprise: Custom pricing for unlimited generations

All subscriptions automatically renew unless cancelled. Prices are subject to change with 30 days notice.

4.1 Credit Policy

Important: Credits are subscription-based and operate on a "use it or lose it" model:

Credits are reset to your plan amount at the beginning of each billing period
Unused credits do not roll over or accumulate to the next billing period
Credits cannot be transferred between accounts or converted to cash

4.2 Cancellation and Credits

When you cancel your subscription:

You retain access to your remaining credits until the end of your current billing period
At the end of the billing period, any unused credits will be permanently removed
Your account will revert to the free tier (if available) after the billing period ends
We recommend using all available credits before your subscription period ends

5. Intellectual Property Rights

5.1 Your Content

You retain all rights to the SVG files you generate using our Service. By creating content, you grant Vector Witch a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of operating and improving the Service.

5.2 Public Gallery and Explore Page

Important Notice: All vector graphics displayed in the Explore page are considered public domain and can be downloaded and used by any visitor. By making your generations public, you:

Grant all users a perpetual, irrevocable license to download and use your generated SVGs
Understand that you cannot later restrict the use of publicly shared content
Acknowledge that other users may download, modify, and use your creations

5.3 Copyright and Trademark Responsibilities

Critical Warning: Users are solely responsible for ensuring their generated content does not infringe on third-party intellectual property rights. This includes but is not limited to:

Copyrighted characters, logos, or designs
Registered trademarks and service marks
Protected brand imagery or trade dress
Celebrity likenesses or publicity rights

Vector Witch does not review generated content for copyright compliance. You agree to indemnify and hold harmless Vector Witch from any claims arising from your use of the Service.

6. Acceptable Use Policy

You agree not to use the Service to:

Generate illegal, harmful, threatening, abusive, or harassing content
Create content that infringes on intellectual property rights
Produce adult, pornographic, or sexually explicit material
Generate misleading or fraudulent content
Violate any applicable laws or regulations
Attempt to bypass usage limits or security measures
Use automated systems or bots without explicit permission
Resell or redistribute the Service without authorization

7. Content Moderation and Removal

We reserve the right to review, modify, or remove any content that violates these terms or is deemed inappropriate. This includes content in the public gallery that:

Infringes on intellectual property rights
Contains offensive or inappropriate material
Violates our acceptable use policy
Is subject to valid DMCA takedown requests

8. API Usage Terms

If you have API access, you additionally agree to:

Not exceed rate limits or abuse the API
Properly attribute Vector Witch when displaying generated content
Not use the API for competitive services without permission
Maintain the security of your API keys

9. Refund and Cancellation Policy

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Upon cancellation:

You will continue to have access to the Service and your credits until the period ends
No partial refunds will be issued for unused time or credits
Any unused credits will be forfeited when the billing period ends
You can reactivate your subscription at any time before the period ends

Refunds: We offer refunds on a case-by-case basis within 14 days of purchase for:

Technical issues preventing service usage
Accidental duplicate purchases
Service not meeting advertised specifications

No refunds are provided for used generation credits or dissatisfaction with generated content quality.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We collect and process personal data in accordance with applicable data protection laws including GDPR and CCPA.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Vector Witch shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Errors or inaccuracies in generated content
Third-party claims arising from your use of generated content
Service interruptions or data loss

Our total liability shall not exceed the amount paid by you in the past 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Vector Witch, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorney's fees) arising from:

Your violation of these Terms
Your use of the Service
Your violation of any third-party rights
Any content you generate or share

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA).

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

17. Severability
