This Digital Millennium Copyright Act ("DMCA") Policy explains how Vector Witch responds to claims of copyright infringement and outlines the procedures for submitting notices and counter-notices under the DMCA.

1. Commitment to Intellectual Property Rights

Vector Witch respects the intellectual property rights of others and expects users of our service to do the same. 3. Filing a DMCA Copyright Infringement Notice

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement through our service, please provide our DMCA Agent with a written notice containing the following information:

  1. Electronic or Physical Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide specific URLs or generation IDs where the content appears.
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and Authority Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3.1 Public Gallery Content

Special Notice: Content in our public Explore gallery may be user-generated. If you find infringing content in the gallery, please include:

  • The specific URL of the gallery page
  • The generation ID or unique identifier of the content
  • The username of the account that created the content (if visible)
  • The date you discovered the infringement

4. DMCA Counter-Notice Procedure

If you believe that your content was wrongfully removed or disabled due to a mistake or misidentification of the material, you may submit a counter-notice to our DMCA Agent containing the following:

  1. Your Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Contact and Consent: Your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Courts of England and Wales if your address is outside of the United Kingdom), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

5. Response to DMCA Notices

5.1 Upon Receipt of a Valid DMCA Notice

When we receive a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the user who posted the material that it has been removed or disabled
  • Document the notice and our actions taken
  • For repeat infringers, terminate the user's account and access to the service

5.2 Upon Receipt of a Valid Counter-Notice

When we receive a valid counter-notice, we will:

  • Send a copy to the original complainant informing them that we may restore the material
  • Wait 10-14 business days
  • Restore the material if the complainant does not file a court action seeking an injunction
  • Notify both parties of our actions

6. Repeat Infringer Policy

Vector Witch maintains a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Our repeat infringer policy includes:

  • First Offense: Warning and content removal
  • Second Offense: Temporary account suspension (7 days)
  • Third Offense: Permanent account termination

7. False Claims

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

8. Modifications to Policy

Vector Witch reserves the right to modify this DMCA Policy at any time. We will post any changes on this page and update the "Last updated" date. Your continued use of the service after any changes indicates your acceptance of the modified policy.

9. No Duty to Monitor

Vector Witch is not obligated to monitor or review user-generated content for copyright infringement. We rely on copyright owners and their agents to notify us of alleged infringement.

10. Preservation of Rights

This DMCA Policy is not intended to limit or expand any rights or remedies under applicable law. Vector Witch retains all rights and defenses available under law.

Before submitting a DMCA notice, please consider:

  • Whether the use constitutes fair use under copyright law
  • Whether the content is actually protected by copyright
  • Whether you own the copyright or are authorized to act on behalf of the owner
